II. License for TV Production Entity

1．License. China implements a licensing system for the establishment of radio and television program production and operating entities or the engagement in radio and television program production and operating activities. The establishment of a radio and television program production and operating entity or engaging in radio and television program production and operating activities shall obtain the Radio and TV Program Production and Business Operation License. However, radio stations and television stations established in accordance with the law are not required to apply for a Radio and TV Program Production and Business Operation License. The Radio and TV Pro gram Production and Business Operation License is valid for 2 years. Only the entities that have obtained the license can go to the administrative department of market regulation for registration or formalities for extending its scope of business, and engage in radio and television program production and operating activities. It should be noted that radio and television programs such as current news and similar topics, columns can only be produced by radio and television broadcasters, and other entities that have obtained the Radio and TV Program Production and Business Operation License shall not produce radio and television programs such as current news and similar topics and columns.

2．Procedures. The central unit and its direct agencies in Beijing shall apply for Radio and TV Program Production and Business Operation License to the State Administration of Radio and Television for approval;other entities applying for the license shall submit the application to the local radio and television administrative department and after gradual review, the application will be reported to the provincial radio and television administrative department for approval. The examination and approval authority shall make a decision on approval or disapproval within 20 working days from the date of receipt of the complete application materials. For those that meet the requirements of the law, the Radio and TV Program Production and Business Operation License shall be issued for the applicant; for those that are not approved, the applicant shall be given a written explanation of the reasons for disapproval. Provincial radio and television administrative departments shall report the examination and approval result to the State Administration of Radio and Television for archival filing within 1 week from the date of the approval or disapproval decision.

3．Conditions. An application for a Radio and TV Program Production and Business Operation License shall conform to the national development planning, layout, and structure of the radio and television program production industry, and meet the following conditions: (1) having the status of an independent legal person, having the name, organization, and charter of the entity in compliance with national laws and regulations; (2) having radio and television, related professionals and workplaces that meet the needs of the business scope; (3) within 3 years before the date of application, no record of violations of laws or regulations of the legal representative, or record of revoking of a Radio and TV Program Production and Business Operation License; and (4) Other conditions stipulated by laws and administrative regulations.

4．Materials. To apply for a Radio and TV Program Production and Business Operation License, the applicant entity shall submit the following materials to the examination and approval authority at the same time: (1) an application report; (2) the charter of the radio and TV program production and operating entity; (3) the application form for the Radio and TV Program Production and Business Operation License; (4) the main personnel materials: ① identification (copy) and resume of the legal representative; ② resumes about radio and TV major and related majors of key management personnel or certifi cations of having participated in relevant professional training of key management personnel (not less than 3); (5) offi ce place certifi cation; and (6) enterprise or entity license or enterprise name approval document issued by the administrative department of market regulation.
